By using the Website, you acknowledge having read and understood these conditions. If you do not wish to be tied to these terms and conditions, you cannot use the Website or order products on line.

1. TERMS OF USE
1.1 Website location
Analyse Capillaire Plus® operates its Website from its offices in Canada (QC). Analyse Capillaire Plus® makes no claims as to the use of the Website or parts thereof outside Canada, or as concerns access to the site from locations where legislation proscribes the use of the site or any of the contents of the Website by law. Anyone deciding to use the Website does so on their own initiative and is responsible for complying with all applicable local laws. All claims in relation with the Website, its contents and use thereof are governed by applicable laws in the Province of Quebec, Canada.

1.2 Restrictions regarding use
Unless otherwise specifically indicated in a section of the Website, copying, reproducing, distributing, publishing, translating, downloading, displaying, and transmitting any part of the Website in any way, shape or form without written authorization from Analyse Capillaire Plus® is strictly prohibited. You may display and/or download items from the Website, but only for non-commercial purposes as long as you do not modify these items and retain all intellectual property notices they contain.

1.3 Brand names
The brand names and logos used and/or displayed on the Website may or may not be registered trademarks by Analyse Capillaire Plus® or third parties. Nothing on the Website can be interpreted in such a way as to permit the direct or indirect use of a trademark shown on the Website without the express authorization from the owner of the trademark concerned.

1.4 Limitation of liability
The Website and the items it contains are provided as is, with no implicit or explicit guarantees. Notwithstanding contrary public legislation, Analyse Capillaire Plus® refutes any and all responsibility and gives no guarantees, particularly as concerns marketable quality and/or appropriateness of use. Moreover, Analyse Capillaire Plus® makes no claims as to the use, validity, exactness, and/or reliability of the items shown on the Website, or as to the results of using such items. Although Analyse Capillaire Plus® makes every effort to make sure the Website is error free Analyse Capillaire Plus® refutes any and all responsibility relative to errors that may appear on the Website. Associated companies, managers, employees, representatives, and/or agents can at no time be held responsible for any damage directly or indirectly related to Website use, particularly as concerns lost data and/or profits associated with the use of items found on the Website, and/or the inability to use said items. 

GENERAL CONDITIONS RELATING TO SALES, RETURNS, REFUNDS, DELIVERIES AND CANCELLATIONS…

When making purchases from the Analyse Capillaire Plus® Website, the following conditions apply:

All purchases are shipped with and require acknowledgement of receipt.

Accepting an order:
Email confirmation of an order does not automatically mean that Analyse Capillaire Plus® accepts said order and does not constitute confirmation that Analyse Capillaire Plus® agrees to sell the merchandise.  Analyse Capillaire Plus® reserves the right to refuse to do business with a customer, without notice, and/or to set a quantity limit of items ordered. Analyse Capillaire Plus® may feel the need to verify personal or credit card information at any time before accepting an order.

1.1 Prices
1.1.1 The price of any product is the price indicated on the Website for each product or service.
1.1.2 Shipping and handling fees and applicable sales taxes are not included.
1.1.3 Analyse Capillaire Plus® reserves the right to adjust the prices of products and services offered on the Website at all times and without notice.
1.1.4 All prices are in Canadian dollars.

1.2 Returns and refunds
1.2.1 Except for software, products may be returned to Capillaire Plus® within 15 days of reception, to the following address:

Invoices and order numbers must be included with the returned products, which must be free of damage and in their original packaging. Return shipments must be made with acknowledgment of receipt. No justification for returns is required by Analyse Capillaire Plus® and no penalty fees apply.

Software sales are official upon activation and thereafter may not be returned for refund.

1.2.2 Return shipping fees and risks are the responsibility of the customer, unless Analyse Capillaire Plus® delivered the wrong products or damaged goods, in which case Analyse Capillaire Plus® shall cover shipping costs and risks, as long as the products are returned using a delivery service that offers guarantees against loss or damage.

1.2.3 Pertaining to aArticles 1.2.1 and 1.2.2, products that have been removed from their original packaging may not be returned. If an item is defective, it will be replaced by another of the same product.

1.2.4 Upon receipt of returned items, all fees charged to your credit card by Analyse Capillaire Plus® for those products, except shipping costs, shall be refunded at the earliest possible date, on condition that the returned products are received at Analyse Capillaire Plus® in the same condition as they were when delivered.

1.3 Product availability
The Website displays all products available from their makers, but these are not necessarily in stock. In the event that Analyse Capillaire Plus® is forced to wait for out-of-stock items to become available, shipment may be delayed.
1.3.1 Analyse Capillaire Plus® does not guarantee that the products displayed on the Website will be available. If Analyse Capillaire Plus® is unable to deliver a given product to you due to stock shortage, Analyse Capillaire Plus® shall notify the customer by Email, who will have the following options:
1.3.1.1 Keep the order open and authorize Analyse Capillaire Plus® to ship the out-of-stock items without notice as soon as they are received from the supplier(s).
1.3.1.2 Cancel the order; credit card payments will be refunded.
1.3.3 Analyse Capillaire Plus® cannot be held liable for any damage or losses resulting from stock shortages.

1.4 Product delivery
1.4.1 Analyse Capillaire Plus® will ship to the address shown on the order form.
1.4.2 Analyse Capillaire Plus® will ship at the earliest possible date following acceptance of orders. Delivery time and fees may vary according to destination. All shipments are made with and require acknowledgment of receipt.

1.4.3 Ownership of and responsibility for the products will be transferred to the customer once they have been handed over to the delivery service by Analyse Capillaire Plus® or its supplier, after which time Analyse Capillaire Plus® cannot be held liable for loss or damage.

1.4.4 All costs associated with duties and other export fees for products delivered outside Canada shall be covered by the customer.
1.4.5 Product delivery is subject to the regulations of the delivery service used by Analyse Capillaire Plus® and/or its suppliers, in this instance Canada Post, and to the regulations of any other delivery service Analyse Capillaire Plus® may use on occasion. In the case of the latter, the customer is obliged to acknowledge receipt. If the customer is absent from the delivery address supplied to Analyse Capillaire Plus®, the shipment will be returned to Analyse Capillaire Plus® as per delivery service regulations.

1.4.6 No shipments shall be made to post office boxes.
1.4.7 Full payment must have been made to Analyse Capillaire Plus® prior to shipment of the items ordered.

1.5 Cancellation
Orders may not be cancelled by customers once payment has been made and accepted by the banking establishment, except for the situations described in Article 1.2 above.

1.6 Liability
1.6.1 In the event that Analyse Capillaire Plus® can be held liable for your order, the amount of the refund shall be limited to the amount paid for the returned products.
1.6.2 Notwithstanding the above, the terms of this article are not meant to or cannot limit the rights of consumers as regards to the public laws and regulations that may apply.

1.7 Force majeure
Analyse Capillaire Plus® cannot be held liable for the non-execution, in whole or in part, of any of its obligations to its customers, or for any associated damage or loss the customer may suffer, if the non-execution, damages and/or losses are the result of force majeure or circumstances Analyse Capillaire Plus® cannot control.

Privacy Policy

Security
Analyse Capillaire Plus® wants to protect the information received through the Internet and customer privacy.
Analyse Capillaire Plus® has implemented security measures to protect customers against loss and/or unauthorized use of the information supplied to Analyse Capillaire Plus®, particularly credit card information. The Monéris server used for online payments has the latest information protection technology (Secure Socket Layers (SSL)), which is highly effective. However, no security system is perfect, and there are always risks that personal information transmitted to Analyse Capillaire Plus® may be used by a third party unbeknownst to Analyse Capillaire Plus® and without authorization. Analyse Capillaire Plus® cannot be held liable for lost or stolen information, unless Analyse Capillaire Plus® acted with negligence. Please be aware that no credit card information is saved on the Analyse Capillaire Plus® server.

What information does Analyse Capillaire Plus® acquire about customers?
In some cases, when products are ordered, Analyse Capillaire Plus® asks for a customer’s contact information and delivery address and, if agreed upon, certain other details. Whenever possible, Analyse Capillaire Plus® will ask customers to verify their personal information and update it if necessary.

What does Analyse Capillaire Plus® do with their customers’ information?
The information acquired by Analyse Capillaire Plus® regarding customers is for order processing and contacting customers should order-based problems occur. Analyse Capillaire Plus® guarantees that its advertisers and/or partners do not have access to confidential customer information. Moreover, Analyse Capillaire Plus® does not sell its lists of users and customers.
